About the case

With decisions in early 2020 (B10-22/15), the German Federal Cartel Office imposed fines totalling 157 million euros on at least 8 major wholesalers of pesticides in Germany. It found that between 1998 and March 2015, the wholesalers made agreements in violation of antitrust law, on uniform price lists, discounts, and sales prices to retailers and end customers. The pesticide wholesalers concerned also conceded their violations of competition law. The violations of competition law identified in the German Federal Cartel Offices’ decisions have a binding effect on the courts in civil proceedings for damages. Furthermore, according to German competition law, there is a presumption that direct and indirect purchasers of pesticides have suffered harm because cartel-affected products had been regularly sold with overcharges. The damage of purchasers is then equal to the difference between this cartel price and the presumed lower price on a cartel free market. Therefore, every farmer who bought pesticide products (herbicides, fungicides, insecticides, etc.) between 1998 and March 2015 or by the expiry of the post-effect-cartel period until March 2016, directly or indirectly via an intermediary from one of the wholesalers involved in the cartel has a right to claim damages.
